Terms of Service & Payment Compliance

These terms govern card and electronic funds transfer (EFT / ACH) payments you make to Ross Towing through this payment page.

1. The parties

Payments on this page are collected by Ross Towing ("we", "us"). Your contractual relationship for goods or services is with us. Card and bank details are captured and processed by our PCI-certified payment infrastructure, whose role is limited to the secure handling and authorised capture of your payment.

2. Card payments (Visa, Mastercard, American Express)

Card payments are processed in compliance with the Payment Card Industry Data Security Standard (PCI-DSS). Card details are captured directly by our PCI-certified tokenisation provider inside an isolated frame on the pay page and are never exposed to, stored by, or transmitted through our servers in plaintext form. Only a one-time tokenised reference is used to authorise your payment.

By submitting card details you authorise us to charge the amount shown on the pay page, plus any processing fee clearly disclosed before you click Pay Now. Processing fees on credit-card transactions, where applied, comply with applicable brand-network rules and local consumer-protection law.

3. EFT / ACH payments

When you choose to pay by bank transfer (Electronic Funds Transfer in Canada or the UK; Automated Clearing House in the United States), you authorise a single debit from the account you designate for the amount, currency, and date shown on the pay page. This authorisation remains in effect until the transaction settles or is declined.

US ACH debits are governed by NACHA Operating Rules. You represent that you are an authorised signer on the account, that the account is a checking or savings account capable of receiving ACH entries, and that the routing and account numbers you provide are correct. Incorrect information may result in a failed or reversed transaction, for which issuer-imposed return fees may apply.

Canadian & international EFT debits are handled under the applicable Payments Canada rules or the local equivalent. Transfers may take one to three business days to post.

Recurring EFT / ACH. If we have enrolled you in a recurring bank-transfer schedule, the schedule shown at the time of authorisation will apply. You may revoke the authorisation at any time by contacting us; revocations take effect within a commercially reasonable timeframe (typically three business days).

4. Chargebacks, returns, and disputes

If you believe a charge is incorrect or unauthorised, contact us first - we can usually resolve disputes faster than a card-issuer chargeback. Formal chargebacks raised with your card issuer are resolved under the relevant card-brand rules. ACH returns (NSF, account closed, unauthorised) are resolved under NACHA rules and the applicable Uniform Commercial Code provisions.

5. Data handling

Card numbers, CVVs, and bank account numbers are transmitted directly to our PCI-DSS Level 1 processor. We store only a non-sensitive token, the last four digits, card brand, and authorisation metadata - enough to resolve receipts and disputes and no more. Email addresses you supply for a receipt are used solely to deliver that receipt.

6. Fraud prevention

Our payment infrastructure applies automated risk scoring, CVV and AVS checks, and velocity limits to each transaction. Suspicious transactions may be held for manual review, declined, or refunded at our discretion. You agree not to submit a payment using a card or bank account you are not authorised to use.

7. Refunds

Refunds are initiated by us in accordance with ourpublished return policy. Refunds to a credit or debit card typically settle within five to ten business days; ACH refunds typically settle within three to five business days, subject to your bank's processing times.

8. Limitation of liability

Our payment infrastructure provider acts solely as payment infrastructure and is not a party to the underlying sale of goods or services. To the maximum extent permitted by law, liability in connection with the processing of any transaction is limited to the amount of that transaction.

9. Governing law

These terms are governed by the laws of the jurisdiction in which Ross Towing is established, without regard to conflict of laws principles.
